Las Vegas, Nevada, April 20, 2026 â The Light System and Jason Shurka have prevailed in federal court following the dismissal of a lawsuit brought by Energy Enhancement System, LLC (EES) in the United States District Court for the District of Nevada.
In an order issued on April 6, 2026, Miranda M. Du granted the Defendantsâ motion to dismiss, ruling that the case is barred under the first-to-file rule. The Court determined that the claims asserted by EES substantially overlap with earlier-filed proceedings involving similar parties and issues.
As a result, the Court dismissed the action in its entirety and denied all other pending motions, including EESâs motions for discovery and a preliminary injunction, as moot. The Clerk of Court has been directed to enter judgment and close the case.
The lawsuit had alleged false advertising, deceptive trade practices, and tortious interference related to competing wellness technologies. However, the Court found that those claims were duplicative of ongoing litigation already filed in other jurisdictions, making the Nevada federal action improper.
